Federal Court Mandates Freedom of Abrego Garcia from Immigration Custody
A federal judge has ordered the prompt discharge of Kilmar Abrego Garcia from immigration custody, finding his ongoing confinement is without lawful basis.
"Since Abrego Garcia's return from wrongful detention in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis wrote in her order.
The situation originates in a erroneous removal to El Salvador in March, which the government later admitted was an mistake. Following his repatriation to the United States to answer human smuggling allegations, he was held in federal detention.
In her order, the court noted that the government does not have a current removal order, which effectively blocks them from deporting Mr. Abrego Garcia "at this time."
