Alina Habba has left her position as the US Attorney for New Jersey. This follows a judicial decision that questioned her right to occupy the role.
Attorney General's Statement
The head of the Justice Department, the Attorney General, confirmed her stepping down on Monday. She commented that the judicial decision made it "untenable" for Habba to perform her duties.
"Do not interpret compliance for surrender," she wrote. "The effort will now extend throughout the nation."

Her resignation follows closely on a US appeals court determined that she had been serving in violation of the law as US attorney. This decision is expected to impact scores of legal proceedings in New Jersey.
The appellate judges ruled that a acting appointment that bypassed the advice and consent of the Senate breached the Federal Vacancies Reform Act.

Bondi said that she will continue working within the Department of Justice as a high-level advisor. Habba plans to pursue additional appeals of the ruling, in the hope of achieving a reversal.
Writing online, she wrote that the court "cannot be permitted to override the President's choice of attorneys tasked with executing the primary duty of the administration of criminal prosecution."

Bondi commended her tenure and pointed out that while she was in charge, the Newark saw a significant drop in criminal activity. It was also reported that the southern city of Camden recorded its first summer in half a century with no murders.

The 41-year-old attorney, was initially recruited to Donald Trump's lawyers in recent years. She later acted for the former president in his hush-money trial in the previous year, when he was conviction on multiple felony counts of document fraud.
Before her appointment to the role of US Attorney, the former president had announced he was appointing her as his White House advisor if re-elected, describing the lawyer as a steadfast ally and a "tireless advocate for justice".
